Program Summary

Retail employees face potential safety hazards in the workplace daily. One only needs to look at social media feeds to witness customer harassment, violent crime, and accidents involving these employees. Unfortunately, these snapshots shared across social media are not isolated incidents, reported data indicates that bad behavior and crime is increasing at retailers nationwide. Not only does this affect retailers’ bottom lines, but retail employees’ physical and mental health are suffering. Concrete steps will be discussed that retailers can implement to protect employees in the workplace. The importance of retailers establishing a workplace violence prevention plan, identifying, and evaluating environmental factors that can lead to safety hazards, implementing corrective measures, and employee assistance programs will be discussed.

Kristina is a co-founder of the OSHA Defense Network and the founder of CACAW Conflict Resolution, LLC. As a practicing attorney and litigator for the past twenty years, Kristina offers a unique perspective by being able to offer insights from all sides of a conflict. Over the years, Kristina has represented individuals as a legal aid attorney, governmental agencies as a federal senior trial attorney, and employers, including Fortune 500 companies, as a Big Law employment and labor attorney.

Kristina worked as Of Counsel in the Albuquerque, New Mexico, office of Jackson Lewis, P.C. Her practice focused on nationwide occupational safety and health and wage and hour issues in the workplace, including a specialization in governmental regulation and investigations.

After spending 15 years litigating and settling cases as a senior trial attorney for the U.S. Department of Labor (DOL), Kristina is not only an expert in occupational safety and health regulations, but she also brings a wealth of knowledge and experience regarding wage and hour, employee retirement and health, retaliation, whistle blower, mine safety, and potential criminal issues that may arise in the workplace. Kristina authors blog articles and presents in podcasts and at conferences on matters including process safety management considerations at chemical and oil refining facilities, retaliation, COVID-19, hazard assessments, enforcement issues arising from potential misclassification of workers, multi-employer worksites, joint employment, temporary workers, and ethical considerations in the litigation of cases. Prior to working for DOL Kristina worked for California Rural Legal Assistance as a statewide health and safety attorney specializing in agricultural workers litigation, legislative and community outreach initiatives. During law school, Kristina served as co-editor of the Environmental Law Review.
