Session I – Beyond the Breach: Legal Duties, Compliance, and Litigation Risks in Cybersecurity – Timothy Shields

This session will explore the legal landscape that governs cybersecurity and fraud prevention for Florida businesses. The presentation focuses on what businesses must do before and after an incident to stay compliant, prevent fraud, and avoid liability. Attendees will learn how data privacy laws and contractual duties create enforceable cybersecurity obligations, and how failure to meet them can lead to regulatory penalties, law suits, and class actions. The session will close with practical measures to reduce exposure and improve incident readiness.

  • Pre-breach legal preparedness: Contractual obligations in vendor and client agreements, compliance with industry standards (FIPA, GLBA, PCI-DSS), documenting cybersecurity measures, and knowing when to engage counsel or notify insurers

I’ll cover how policies respond to ransomware, data loss, and privacy claims; what underwriters look for and how security controls affect terms and pricing; and how to pick an insurer and prepare submissions that avoid surprises. We’ll close with concrete tips you can use immediately, whether you’re protecting your own firm or advising clients.

With experience managing complex breach claims across North America and Latin America, Kevin helps insurers and their counsel navigate fast-moving incidents with clarity and confidence. His focus is on ensuring insureds, brokers, insurers, and breach counsel receive the technical support they need — with the responsiveness, reporting, and compliance standards insurers expect.

Kevin holds industry certifications including CIPP/US, CIPP/C, CCIS, and AIGP, reflecting his commitment to staying ahead in privacy law and cyber insurance.

Beyond his role at CYPFER, Kevin is dedicated to industry education and thought leadership. As chair of the Planning Subcommittee for the Florida Bar’s Cybersecurity and Privacy Law Committee, he leads initiatives to strengthen legal professionals’ cybersecurity competence. Timothy’s educational journey is as impressive as it is diverse. He earned his Bachelor of Science and Master’s degrees in Higher Education Administration from the University of Central Florida. He then obtained a Master’s degree in Computer Information Systems and a Doctorate in Organizational Leadership from Nova Southeastern University. While working full-time, Timothy pursued his law degree at NSU’s Shepard Broad College of Law, where he graduated summa cum laude and as Valedictorian. During his time in law school, he served as the Managing Editor of the Nova Law Review and received Highest Grade awards in multiple courses, including Civil Pretrial Practice, Professional Responsibility, Business Entities, Evidence, Legal Research and Writing I & II, Property, and Torts. He made the Dean’s List every semester, exemplifying his commitment to academic excellence.

Currently, Timothy is furthering his expertise by pursuing an LLM in Intellectual Property from the University of New Hampshire. His commitment to professional development is evident in his numerous certifications, including Certified Information Privacy Professional (CIPP/US), advanced certifications in Lexis-Nexis and Westlaw, and a Black Belt in Lean Six Sigma.
