Program Summary

The recent Stericycle decision by the National Labor Relations Board has made drafting employee handbooks much more difficult for employers. Months after this decision employers are still trying to determine what policies they can and cannot include in their handbooks. This decision has resulted in companies needing to work to ensure that their policies are not overbroad and are narrowly tailored to avoid a violation and possible charge. For these reasons, companies are now scrambling to correct and update their handbooks.

Key topics to be discussed:

  • The recent decision in Stericycle and the NLRB’s continued cases and guidance regarding workplace policies
  • Understanding the policies that are most at risk of violating the law
  • The need to narrowly tailor workplace policies
